"Here We Go Again"

Today the California Supreme Court is hearing arguments concerning Proposition 8. Yesterday, this article was posted to the Daily Kos *waves to author*:

So, we've come down to it, folks. Tomorrow, the California Supreme Court will hear arguments about a proposition that was designed to strip rights away from a minority population - Proposition 8.

Wait a minute. Weren't we just here a year ago?

Why yes, we were. As a matter of fact, exactly one year ago today, the California Supreme Court heard arguments about a proposition that was designed to strip rights away from a minority population - Proposition 22.

(This is only the first three paragraphs, of course.)

I hope very much that the grave injustice of Proposition 8 will be undone. I thought I had more to type but, really, that is it.

Like my grandmother says, from your mouth to god's ears. May it be so.

Frankly, I think the arguments that were advanced weren't very good. I think the California court was likely to accept a federal equal protection argument on the grounds that marriage was a fundamental right and that strict scrutiny would apply, instead of the various procedural arguments that were used. I know that would leave open the possibility of going to the Supremes, but I think Kennedy might buy that argument as well.
